SMS Terms & Conditions

1. Introduction

AgentX LLC ("we," "us," or "our") provides SMS and text messaging services to our clients and their customers as part of our business communication platform. By opting in to receive SMS messages from AgentX LLC or any of our clients using our platform, you agree to these SMS Terms & Conditions. These terms supplement our Privacy Policy and Terms & Conditions.

2. Consent & Opt-In

By providing your phone number and opting in to receive text messages, you expressly consent to receive recurring automated SMS/MMS messages from AgentX LLC and/or the business you engaged with. Consent is obtained through one or more of the following methods:

Web Forms:Submitting a contact form, booking form, or lead capture form on our website or a client's website that includes an SMS consent checkbox or disclosure.
Verbal Consent:Providing verbal consent during a phone call with one of our AI voice agents or human representatives, which is recorded and logged for compliance.
Keyword Opt-In:Texting a keyword (e.g., START, YES, SUBSCRIBE) to one of our designated phone numbers.
Account Registration:Creating an account on our platform and agreeing to receive SMS notifications as part of the registration process.
Third-Party Referral:Being referred by a business client who has obtained your prior express written consent to receive messages on their behalf through our platform.

Consent to receive SMS messages is not a condition of purchase. You may opt out at any time (see Section 5 below).

3. Types of Messages

Depending on your relationship with AgentX LLC or our clients, you may receive the following types of SMS messages:

  • Appointment Confirmations & Reminders: Notifications about scheduled calls, demos, or meetings.
  • Follow-Up Messages: Automated follow-ups after a call, form submission, or inquiry.
  • Service Notifications: Updates about your account, campaign status, or platform activity.
  • Promotional Messages: Information about new features, services, or special offers (only with your explicit opt-in consent).
  • Two-Factor Authentication: Security codes for account verification.
  • AI Agent Communications: Automated messages from AI-powered voice and text agents as part of our outreach and customer engagement services.

4. Message Frequency & Rates

Message frequency varies based on the nature of your interaction. You may receive up to 10 messages per month per campaign or service you have opted into. Message and data rates may apply depending on your mobile carrier and plan. AgentX LLC is not responsible for any charges incurred from your wireless provider.

5. How to Opt Out

You may opt out of receiving SMS messages at any time using any of the following methods:

Reply STOP:Text STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any message you receive from us. You will receive a one-time confirmation message and no further messages will be sent.
Email Us:Send an opt-out request to [email protected] with your phone number and a request to be removed from SMS communications.
Call Us:Call (317) 597-1998 during business hours to request removal from our SMS list.
Account Settings:If you have an account on our platform, you can manage your SMS preferences in your notification settings.

After opting out, you will receive a final confirmation message: "You have been unsubscribed and will no longer receive messages from AgentX LLC. Reply START to re-subscribe."

7. Privacy & Data Protection

We take your privacy seriously. Your phone number and SMS consent information are handled in accordance with our Privacy Policy. Specifically:

  • Your phone number will only be used for the purposes described in these terms.
  • We will never sell, rent, or share your phone number with third parties for their marketing purposes.
  • Your opt-in consent data (including timestamp, source, and method) is securely stored and available for audit purposes.
  • All SMS communications are transmitted through encrypted, carrier-approved channels.

8. TCPA & Regulatory Compliance

AgentX LLC complies with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and all applicable federal, state, and carrier regulations governing SMS communications. We maintain records of all opt-in consents and honor all opt-out requests promptly. Our messaging practices adhere to the CTIA Messaging Principles and Best Practices, and we are registered with The Campaign Registry (TCR) for 10DLC compliance.

9. Supported Carriers

Our SMS services are compatible with all major U.S. wireless carriers, including but not limited to AT&T, T-Mobile, Verizon, Sprint, U.S. Cellular, and their MVNOs. Carriers are not liable for delayed or undelivered messages.

10. Changes to These Terms

We reserve the right to update these SMS Terms & Conditions at any time. Changes will be posted on this page with an updated effective date. Continued receipt of SMS messages after changes are posted constitutes your acceptance of the revised terms.
